Today was supposed to be the contempt hearing against Carmen for denying visitation to Stewart. We found out at the last minute this morning that Carmen’s lawyer filed for a continuance. The hearing is now scheduled for February 3. Bruce said he talked to Philip M several weeks ago. He no longer represents Carmen. New attorney, Corina B called Bruce 2-3 weeks ago to talk about continuance. He said he doesn’t know when the decision was made to continue to February 3, 2004 at 10AM.
Since we had already allocated the time and ended up not going to court, we decided to make some phone calls to follow up on Carrie’s medical records. We called Dr. P’s office. Kaya answered the call. We told her that we were calling to request updated records for Carrie. Kaya was reluctant to talk to us to the point of almost being rude. She said that HIPAA prevented her from talking to us. I explained that Stewart (on the phone also) was Carrie’s father and had a right to her records. We ended up having to fax her a copy of the divorce decree, pointing out the paragraph that stated anyone who fails to provide current records could be held in contempt of court. We called back a while later to verify that she received the fax. She ended up explaining that Carmen had instructed them not to talk to us. Once we got past that little barrier, she warmed up to us quite nicely. She went over some of Carrie’s recent chart activity.
Dr. P last saw Carrie on September 26, 2004. After that, Carmen switched to Susan C, DO. The following is detail of recent chart activity:
November 2 – well-child checkup.
November 9 – Diaper rash
November 10 – UTI, antibiotic prescribed
November 11 – Cincinnati Children’s ER
November 12 – vomiting
December 6 – pre-op exam for upcoming endoscopy ordered by Dr. K2 (male) at the CCHMC feeding clinic.
December 8 – Endoscopy at Childrens Hospital in Cincinnati.
Kaya Faxed me an authorization form for Stewart to sign in order to get a copy of Carrie’s records. Carrie’s next well-child check-up is scheduled for April 8, 2005.
